ADVANCEFLASH TERMS & CONDITIONS OF USE
1. ACCEPTANCE OF TERMS
The following Terms and Conditions of Use (the "Agreement") constitutes an agreement between you ("You") and ADVANCEFLASH, operator of www.advanceflash.com (the "Site"). By using the Site, you agree to be bound by and accept the terms of this Agreement.
2. MODIFICATIONS TO THIS AGREEMENT
ADVANCEFLASH reserve the right, at our sole discretion, to change, modify or alter these terms and conditions of this Agreement at any time. Such modifications shall become effective immediately upon posting. This entire Agreement dated November 16th, 2009 supersedes all prior agreements, understandings, or representations with respect to the terms and use of this site. This Agreement may not be modified or amended except as expressly agreed in writing signed by an authorized agent of ADVANCEFLASH.
3. WEBSITE CONTENT
The Site contains videos, images, animations, sound effects, flash objects, buttons, special effects, music, fonts, clip art, and any other audio/video content recorded in any format ("Digital Media Files"), owned by AdvanceFlash available for licensed use under the terms of ADVANCEFLASH LICENSE AGREEMENT. The Digital Media Files are the properties of ADVANCEFLASH and/or its licensors.
Other Non Digital Media Content on the Site is the property of ADVANCEFLASH. ADVANCEFLASH makes its best efforts to ensure the accuracy of the other content on the Site, but makes no warranties or representations, nor shall be liable for any damages arising from, any inaccuracy of other content on the Site.
4. THIRD PARTY CONTENT, OFF-SITE LINKS, AND SERVICES
The site may contain third party content, offsite links and services that links to the World Wide Web content which is not part of the Site. You agree and acknowledge that ADVANCEFLASH is not responsible for such Content.
5. PRIVACY POLICY
Our Privacy Pledge to You, Our Customers, Users, and Subscribers. ADVANCEFLASH respects your privacy, therefore we treat any identifiable information regarding our customers, users, and subscribers with the utmost confidence. Any information you give us is held with the highest professional care and security, and will not be used in ways to which you have not consented. You may occasionally receive quality special offers from our online partners, strictly without obligation of course, and only where you have opted in to do so. We may share personal information, including contact and billing information, with such online partners after you accept their offer.
When you purchase products from ADVANCEFLASH or use our services, you can opt-in to receive email regarding updates about exclusive offers, new products, and new services. 6. USE OF THE SITE
Use of and access to the Site is limited by the terms of this Agreement. You agree:
(I) Not to use any spider, scraper, robots or any other automated means to access the Site for any purpose without ADVANCEFLASH express written permission.
(II) Not to take any action that imposes, or may impose in ADVANCEFLASH sole discretion, an unreasonable or disproportionately large load on ADVANCEFLASH servers or other infrastructure or to interfere or attempt to interfere with the proper operation of the Site or any activities conducted on the Site.
(III) Not to copy, reproduce, modify, create derivative works from, distribute or publicly display any Media from the Site, including but not limited to "framing" Site Media within another site, except that you may use Digital Media Files validly licensed by ADVANCEFLASH to You under ADVANCEFLASH's LICENSE AGREEMENT.
(IV) To use the Site only for lawful purposes, and to comply with all applicable laws and regulations in connection with your use of the Site.
(V) Not to advertise products or services or solicit any user of the Site, whether or not such advertising or solicitation is in the form of unrequested bulk commercial email.
7. TERMINATION OF USE
ADVANCEFLASH may at its sole discretion terminate or limit your use of the Site for violation of any of the rules contained in this Agreement, or for any conduct, whether by act or omission, which in ADVANCEFLASH's sole opinion adversely impacts the operation of the Site. ADVANCEFLASH may so terminate or limit your use of the Site without prior notice to you. If such termination or limitation is for reasonable cause, ADVANCEFLASH will not be obligated to refund any fees paid by you.
8. INTELLECTUAL PROPERTY
"ADVANCEFLASH" and www.advanceflash.com are trademarks of Select Publishing Group. All content on this Site and Site layout are copyright by ADVANCEFLASH. The visual appearance of the Site is protected trade dress of ADVANCEFLASH Copyrights
9. DISCLAIMER OR WARRANTIES
ADVANCEFLASH HEREBY WAIVES ALL WARRANTIES EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR AN INTENDED USE, IN CONNECTION WITH THE SITE.
10. LIMITATIONS OF LIABILITY
IN NO EVENT WILL ADVANCEFLASH OR ITS AFFILIATES, SUPPLIERS AND LICENSORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, ECONOMIC, COVER, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE DIGITAL MEDIA FILES, WITHOUT LIMITATION, DAMAGES OR COSTS RELATING TO THE LOSS OF PROFITS, BUSINESS, GOODWILL, DATA, TIME OR COMPUTER PROGRAMS, COMPUTER HARDWARE OR CD-ROM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL ADVANCEFLASH AND ITS AFFILIATES’, SUPPLIERS’ AND LICENSORS’ LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE DIGITAL MEDIA FILES REGARDLESS OF THE FORM OF THE CLAIM (INCLUDING, WITHOUT LIMITATION, ANY CONTRACT, PRODUCT LIABILITY, OR TORT CLAIM). BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
ENTIRE AGREEMENT. This entire Agreement dated November 16th, 2009 supersedes all prior agreements, understandings, or representations with respect to the Digital Media Files. This Agreement may not be modified or amended except in a writing signed by you and ADVANCEFLASH.
